Attorney – Consumer Litigation & Debt Collection Defense
Location: Phoenix, AZ (Onsite, 5 days/week)
Reports To: Chief Operating and Legal Officer
About the Role
We are seeking a licensed Attorney to join our legal team in a fast‑paced, compliance‑focused environment. This role focuses on defending consumer claims and regulatory matters, with a strong emphasis on debt collection defense and consumer protection litigation.
This position is fully onsite in Phoenix, AZ, and is ideal for a motivated attorney or emerging legal professional interested in litigation strategy, regulatory compliance, and managing high‑volume caseloads within a dynamic business setting.
Responsibilities
Litigation & Case Strategy
- Defend lawsuits involving debt collection, consumer protection, and related regulatory claims.
- Develop and implement litigation strategy from initial evaluation through final resolution.
- Draft, review, and file pleadings, motions, discovery responses, and other court filings in state and federal courts.
- Manage a high‑volume caseload while ensuring compliance and maintaining strategic oversight.
Court Representation & Case Resolution
- Appear in court for hearings, mediations, arbitrations, and trials, as required.
- Negotiate settlements, dismissals, and resolutions aligned with company objectives and risk posture.
- Coordinate with outside counsel when necessary, including performance management and budget oversight.
Compliance & Risk Management
- Advise leadership on litigation exposure, regulatory developments, and risk mitigation strategies.
- Collaborate with compliance, collections, and operations teams to ensure adherence to:
- Fair Debt Collection Practices Act (FDCPA)
- Fair Credit Reporting Act (FCRA)
- Telephone Consumer Protection Act (TCPA)
- Relevant state consumer protection and collections laws
- Oversee discovery activities, including interrogatories, depositions, and document production.
- Review contracts and documentation to ensure litigation preparedness.
- Assist in developing internal policies, procedures, and best practices to reduce regulatory risk.
- Maintain accurate litigation tracking and reporting systems, including forecasting and budget management.
