    Description

    Blue Sky Innovative Solutions is looking for a contracted Temporary Compliance Manager for our government client.
    LOCATION
    • Largo, MD – this is an in office position - but Hybrid working Monday - Friday.

    1. Legal Review and Advisory Services
    • Provide legal review and recommendations to Public Works and Transportation on
    matters involving public infrastructure, capital improvement projects, transportation
    programs, construction, maintenance, operations, and related governmental activities.
    • Research and interpret applicable federal, state, and local laws, regulations, ordinances,
    policies, and administrative requirements.
    • Identify legal risks and provide practical recommendations to management, project
    teams, procurement personnel, engineers, and other stakeholders.
    • Serve as a liaison to the Office of Law on legal matters involving Public Works and
    Transportation.
    • Coordinate legal guidance with the Office of Law and other appropriate stakeholders as needed.

    2. Contract and Procurement Document Review
    • Review, draft, revise, and provide legal guidance regarding contracts and procurement
    documents associated with public works and transportation projects.
    • Review construction contracts, professional services agreements, architectural and
    engineering agreements, task orders, solicitations, invitations for bids, requests for
    proposals, amendments, change orders, memoranda of understanding, intergovernmental
    agreements, easements, permits, licenses, and related instruments.
    • Ensure contractual provisions appropriately address scope, payment, insurance,
    indemnification, liability, warranties, dispute resolution, termination, compliance
    requirements, and allocation of risk.
    • Identify and recommend revisions to contract terms that may create legal, financial,
    operational, or compliance risks.
    • Support procurement personnel and project teams in resolving legal issues arising during
    the solicitation and contracting processes.

    3. Legal Sufficiency and Compliance
    • Conduct legal sufficiency reviews of proposed contracts, agreements, procurement
    actions, project documents, resolutions, and other matters requiring legal approval.
    • Determine whether documents are legally enforceable, properly authorized, consistent
    with applicable procurement and contracting requirements, and sufficient to protect the
    governmental entity's interests.
    • Review matters for compliance with applicable public contracting, competitive
    procurement, transportation, construction, environmental, funding, ethics, records, and
    governmental authority requirements.
    • Identify deficiencies, legal risks, and compliance concerns requiring correction or
    additional review.
    • Document legal findings, conditions, exceptions, and required revisions prior to
    execution or approval.
    • Confirm that required approvals, signatures, certifications, and supporting documentation
    are complete and properly maintained.

    4. Project Support, Risk Management, and Coordination
    • Provide ongoing legal support throughout the planning, procurement, contracting,
    construction, and closeout phases of public works and transportation projects.
    • Participate in project and contract meetings and provide legal guidance on issues
    affecting project delivery.
    • Assist with contract negotiations and evaluate claims, disputes, contractor performance
    issues, delays, change orders, and potential contract remedies.
    • Coordinate with internal departments, outside counsel, consultants, regulatory agencies,
    and other governmental entities as appropriate.
    • Serve as a liaison to the Office of Law on special projects and coordinate legal review,
    communication, and follow-up for assigned initiatives.
    • Maintain organized legal files and review records.
    • Track significant legal issues, required actions, and applicable deadlines.
    • Assist in developing standardized contract provisions, templates, procedures, and legal
    review practices to improve consistency and reduce organizational risk.
    5. Maryland Public Information Act (MPIA) Legal Review and Compliance
    • Conduct legal review of Maryland Public Information Act requests to determine
    applicable exemptions, confidentiality requirements, disclosure obligations, and other
    legal considerations.
    • Review responsive records to identify information that may be subject to withholding,
    redaction, or other protections under applicable law.
    • Prepare legally sufficient responses to MPIA requests and assist in ensuring responses are timely, complete, and consistent with statutory requirements.
    • Advise DPW &T program areas on MPIA compliance strategies, records review,
    preservation, disclosure, and redaction requirements.
    • Coordinate with the Office of Law on complex, sensitive, disputed, or otherwise
    significant MPIA matters.
    • Ensure disclosures and responses are consistent with Maryland law, County policies,
    applicable confidentiality requirements, and records-management obligations.

    6. Legal Sufficiency Review of Legislation and Policy
    • Conduct legal sufficiency reviews of draft departmental legislation, amendments,
    regulations, resolutions, policies, procedures, and related documents to ensure alignment
    with applicable federal, state, and County laws.
    • Review proposed legislation, County Council bills, regulatory changes, and other
    governmental actions to determine potential legal and operational impacts on DPW&T.
    • Identify DPW&T's legal responsibilities, compliance obligations, and required
    implementation actions arising from enacted or proposed legislation.
    • Advise departmental leadership and program areas regarding legal issues associated with legislative proposals and policy initiatives.
    • Coordinate with the Office of Law, legislative staff, and other appropriate stakeholders
    regarding legal questions, proposed revisions, and implementation requirements.
    • Assist in drafting or revising departmental legislative proposals, amendments, testimony,
    briefing materials, and related supporting documents as appropriate.

    7. Review and Assessment of Legal Demand Packages, Claims, and Notices
    • Conduct legal review of demand letters, claims packages, subpoenas, notices of intent,
    litigation-related correspondence, and other legal notices received by DPW &T.
    • Assess the nature of the matter, applicable deadlines, potential departmental obligations,
    and immediate actions are required to preserve the County's legal interests.
    • Identify and coordinate the collection and preservation of relevant records, documents,
    communications, and other information.
    • Assess potential liability, contractual exposure, compliance obligations, and operational
    implications in coordination with the Office of Law.
    • Coordinate with the Office of Law, Risk Management, departmental leadership, program
    areas, and other appropriate stakeholders regarding required responses and follow-up
    actions.
    • Advise DPW &T program areas on appropriate actions in response to claims, demands,
    subpoenas, notices, and other legal matters.
    • Track significant legal notices, response deadlines, assignments, and resolution status to
    ensure timely departmental action.

    Required Skills and Qualifications
    • Must have at least 5 years of prior experience working as a compliance manager or in a similar position
    • A JD not required, but the candidate must have at least 5 years of experience in legal and/or program review. 
    • Proficiency in industry trends, laws, and regulations
    • Outstanding analytical skills and problem-solving abilities
    Preferred skills and qualifications
    • Experience in risk management or auditing
    • Exposure to curating, executing and monitoring compliance project

    EDUCATION
    A bachelor's degree in business administration, law, finance, or a related field;

    PHYSICAL, MENTAL, AND ENVIRONMENTAL CONDITIONS
    • Must have the use of sensory skills to effectively communicate and interact with other employees and the public using the telephone and personal contact as normally defined by the ability to see, read, talk, hear, handle or feel objects and controls and may carry equipment and supplies up to 49 pounds. Physical capability to effectively use and operate various items of office related equipment, such as, but not limited to a, personal computer, calculator, copier, and fax machine. No significant climbing, stooping, kneeling, crouching, reaching, standing, walking, pushing, pulling, lifting, grasping, and repetitive motions.
