    Location: Charles Town, WV | Martinsburg, WV | Winchester, VA

As we continue to grow, we are seeking an experienced Pre-Litigation Attorney, licensed in Virginia and/or West Virginia, to join our team and advocate for injury victims throughout the region.

    Your Mission

    As a Pre-Litigation Attorney, you will take primary responsibility for managing personal injury cases from intake through demand and pre-suit settlement negotiations in Virginia and/or West Virginia, depending on your licensure. You will build strong case foundations, advocate for clients at every stage of the pre-suit process, and collaborate with a team committed to achieving results. You will work closely with the litigation team to ensure a seamless transition for any case that requires filing suit.

    Key Responsibilities

    Case Evaluation and Pre-Suit Strategy

    • Serve as primary attorney for personal injury cases during the pre-litigation phase, managing files from intake through demand, negotiation, and pre-suit resolution.
    • Evaluate liability, damages, and case value under Virginia and/or West Virginia law to develop sound pre-suit strategies.
    • Prepare and issue demand packages and supporting documentation to insurance carriers.
    • Negotiate settlements with insurance carriers and opposing counsel to maximize client recovery without the need for litigation.
    • Identify cases that warrant referral to the litigation team and ensure a smooth, well-documented handoff.

    Case Management and Client Advocacy

    • Manage a caseload of personal injury matters, including motor vehicle accidents, premises liability, wrongful death, and other negligence claims.
    • Provide proactive, compassionate communication to clients while guiding them through the pre-litigation process.
    • Collaborate with investigators, medical providers, and other professionals to build well-documented, compelling claims.
    • Ensure all matters are handled efficiently, ethically, and in accordance with firm standards.
    • Work closely with paralegals and legal assistants to maintain case momentum and exceptional client service.

    Team Collaboration

    • Partner with attorneys and leadership across the firm to align pre-suit strategy with overall case objectives.
    • Coordinate with the litigation team to ensure continuity for cases proceeding to suit in Virginia and/or West Virginia courts.
    • Mentor junior legal staff as appropriate and contribute to a collaborative team environment.
    • Participate in professional networking and community events that support the firm's reputation and relationships.

    Qualifications

    • Juris Doctor (JD) from an accredited law school.
    • Active license to practice law in Virginia and/or West Virginia required.
    • Minimum of 2 years of personal injury experience, with a focus on case evaluation, demands, and settlement negotiation.
    • Strong knowledge of personal injury law and insurance claims practices in Virginia and/or West Virginia.
    • Excellent negotiation, case evaluation, and case management skills.
    • Strong written and verbal communication skills.
    • Valid driver's license and reliable transportation.

    Preferred

    • Licensed in both Virginia and West Virginia (and/or Maryland).
    • Experience handling cases in multiple jurisdictions.
    • Established relationships within the Virginia and/or West Virginia legal and insurance community.
