About The Position:

The Loss Recovery Deficiency Collector resolves deficiency balances on charged-off auto loans after vehicle repossession and disposition. The role verifies each deficiency, negotiates payment in full, settlement, or payment arrangements, and recommends legal action when appropriate.

Essential Responsibilities

  • Make and receive calls with former customers to negotiate repayment or settlement of post-repossession deficiency balances, within approved settlement authority.
  • Validate deficiency calculations before collection. This includes reviewing sale proceeds, repossession, storage, and remarketing expenses, and credits from GAP, insurance, and cancelled ancillary products.
  • Confirm that required pre-sale and post-sale notices were sent on time and are complete. Escalate any defect that may limit or bar collection of the deficiency.
  • Run skip tracing and asset searches, including through outside vendors, to locate obligors and assess collectability.
  • Track statute of limitations dates, and do not pursue legal action on time-barred balances.
  • Recommend legal action. Coordinate approved suits, judgments, wage garnishments, and liens with the in-house legal department.
  • Resolve customer disputes and credit reporting disputes accurately and on time.
  • Document all contacts, promises, and settlements in the servicing system, and meet recovery and quality targets.
  • Evaluate delinquent portfolios and recommend accounts for repossession upon customer default.
  • Other duties as assigned.

Essential Requirements

  • 5+ years of collections experience, including 3+ years on charged off or deficiency accounts. Subprime auto finance experience preferred.
  • Working knowledge of the repossession and remarketing process and how deficiency balances are calculated.
  • Ability to read, interpret, and apply federal, state, and local collection and repossession regulations, including UCC Article 9 disposition requirements, state retail installment sales laws, the FDCPA and Regulation F, state debt collection laws, and the FCRA.
  • Strong negotiation, communication, and problem-solving skills.
  • Professional, tactful, and empathetic manner with customers in financial hardship.
  • Ability to work independently and as part of a team in a fast-paced environment.
  • Available for a flexible schedule and overtime as needed.
  • Bilingual (English/Spanish) a plus.
