Provides legal services in support of assigned litigation matters. Maintains responsibility and accountability for a caseload and works collaboratively with claims professionals, insureds, and business partners to achieve favorable outcomes. Handles litigation matters requiring legal analysis, sound judgment, and the ability to manage competing priorities in a fast-paced environment. Manages cases through various stages of litigation, including investigation, discovery, motion practice, settlement negotiations, and resolution.JOB DESCRIPTION:
Essential Duties & Responsibilities
Handles insurance defense or coverage matters through all stages of litigation, including Trial. Manages litigation preparation and develops case strategy. Prepares and directs the preparation of necessary materials, including briefs, motions, discovery, depositions, and expert-related matters. Evaluates litigation and settlement strategies and actively drives cases toward resolution with an appropriate sense of urgency.
Handles court appearances, motion practice, discovery, negotiations, and trial-related activities as necessary. Participates in bench and jury trials in state and federal court, as appropriate.
Communicatesregularly and concisely with clients, claim professionals, leadership and others to ensure appropriate level of understanding and documentation exists for effective case management.
Conducts legal research and analysis of facts and information to provide counsel and guidance on legal questions or issues.
Prepares opinions or position papers on various legal issues and interpretation of legal issues/provisions.
Counsels client/management/claim professionals to avoid legally unsound decisions or plans and when changes in the law occur.
May assist in training or mentoring attorneys, paralegals, and department staff on appropriate procedures.
Collaboratively workswith clients, claim professionals, underwriting, risk control and other third parties while resolving legal issues.
Works independently in resolving legal cases with oversight supervision.
Responds to government regulatory agencies as needed.
