Description & Requirements

The Global Data Privacy Counsel will be responsible for supporting and implementing all aspects of the Firm's global data privacy compliance strategy and advising the Firm on legal data privacy matters with appropriate input from local in-country support.

The role-holder will be an integral member of the Office of General Counsel, leading global data privacy initiatives and ensuring compliance across the Firm's jurisdictions.

Main responsibilities:

• Lead the Firm's global data privacy compliance program as part of the Office of General Counsel; work with and advise the member firms and entities of Baker McKenzie globally on compliance with data privacy laws (e.g. GDPR and other country/state specific laws); manage a small team of junior lawyers and delegate work appropriately based on seniority/experience
• Review large firm projects for compliance with data privacy and professional secrecy laws; perform Data Privacy Impact Assessments; support the adoption of appropriate compliance measures; instill a culture of early review and privacy by design and default; advise senior management on residual risks
• Draft, review and negotiate data privacy terms in supplier contracts (e.g. Art 28 terms, EU SCC, CCPA, AI, professional secrecy, etc.); advise on risk and liability issues; work closely with the Firm's security experts on contractual security requirements; continuous review and improvement of contract templates
• Review data privacy terms with client; respond to client audit questionnaires; develop and maintain guidance material for clients
• Review contractual terms with AI vendors from a data privacy/professional secrecy perspective; advise on user guidance; support the development and implementation of Firm AI policies; draft and negotiate contractual restrictions governing the use of Firm data in the context of AI tools; review proposed internal use cases of AI; perform DPIAs in respect of AI tools
• Work with a multi-disciplinary team of senior stakeholders to establish and maintain the highest standards of data governance throughout the global Firm
• •Manage the Firm's intra group data transfer agreements to ensure they continue to reflect the activities of the Firm's global business, evolve data privacy laws and local regulatory requirements
• Lead the Firm's Global Data Privacy Working Group comprised of data privacy experts in multiple jurisdictions; liaise with the group to ensure compliance with local laws and latest best practice
• Raise awareness of security risks and reporting requirements within the workplace; maintain policies; manage the legal aspects of security breach response; liaise with local offices in respect of local reporting requirements; work closely with the Firm's global information security team
• Stay up-to-date on new legal developments globally; analyze the impact on the Firm's global business; liaise with relevant business units to update policies and procedures as required; provide seminars and other training materials
• Draft data privacy notices, terms of use and privacy policies to ensure data subjects are fully informed of the uses and disclosures that will be made of their personal data
• Advise on global marketing solutions, AdTech and marketing campaigns to ensure compliance with applicable marketing laws
• Manage privacy aspects related to the Firm's website (e.g. Privacy and Cookies Statement, CCPA disclosures, cookies consent management tool, etc.)
• Manage data subject rights requests under GDPR, CCPA and other data privacy laws (e.g. rights of access, amendment, deletion, etc.); respond to general inquiries received via the Firm's general data privacy inbox

Skills and experience:

• A qualified lawyer with excellent academics credentials and a minimum of 10+ years PQE

• Demonstrate deep knowledge of GDPR and expertise in other global data protection laws and practices

• Have the ability to develop data privacy awareness at all levels within the global firm and explain technical points in clear concise terms taking account of the relevant audience

• Strong ability to balance conflicting interests and viewpoints with confidence and provide pragmatic, solution-driven advice Strong attention to detail

• Excellent working knowledge of Microsoft PowerPoint, Word, Excel and online research tools

• High work standards

• Excellent writing, organizational and problem-solving skills.

• Strong client service orientation

• Ability to prioritize and work to tight deadlines and manage own workload

• Good communication skills, including the ability to liaise with people across different cultures with different legal systems

• Ability to work well in both a team and individually
