Description

Position: Director of Compliance

Reports to: CEO

Hours/Schedule: Full Time

Location: Brooklyn, NY

Salary Range: $125,000 to $155,000 per year

Position Summary:

Founded in 1866, Brooklyn Community Services (BCS) empowers children and families to reach their full

potential, strengthen families, and foster self-sufficiency in adults. With programs in multiple locations

throughout Brooklyn, BCS serves thousands of individuals and families each year.

The Director of Compliance is a hands-on leadership position responsible for creating, implementing, and

maintaining BCS’s compliance program, including a comprehensive Medicaid Compliance Program to

prevent, detect, and address fraud, waste, and abuse. Working directly with program and administrative

leaders, the Director builds compliance systems where they may not exist and strengthens existing

processes. The Director develops policies, procedures, forms, tracking tools, and training; reviews records;

conducts site visits, audits, and investigations; and works with staff to identify root causes and implement

corrective action. The Director clarifies departmental accountability, verifies adherence, and reports

significant concerns to the CEO and, at least quarterly, to the Board Audit Committee and Finance

Committee. Program and administrative leaders remain responsible for executing requirements within

their functions. Compliance develops the central framework, monitors and verifies adherence, and tracks

corrective action. The role supports BCS’s mission and protects its people, resources, reputation, tax-exempt

status, and public trust.

Responsibilities:

Compliance Program

  • Conduct an initial assessment of BCS’s existing compliance structure, policies, contracts, monitoring practices, open findings, reporting processes, and department-level responsibilities.
  • Create and maintain an organization-wide compliance obligations register identifying the requirement, source, owner, deadline, evidence required, status, and escalation path.
  • Establish a centralized compliance calendar for licenses, certifications, contracts, registrations, reports, training, audits, monitoring visits, policy reviews, and annual filings.
  • Develop and maintain a policy and procedure inventory, identifying missing, outdated, or inconsistent policies.
  • Develop practical compliance tools, including checklists, tracking logs, templates, audit instruments, corrective-action plans, and manager guidance.
  • Develop an annual compliance work plan and risk-based monitoring plan, subject to CEO and Board review.
  • Recommend the staffing, systems, external expertise, and resources needed to sustain the compliance function.

Program, Contract, and Regulatory Compliance

  • Work directly with program leaders to establish compliance systems, files, monitoring schedules, and corrective-action processes for programs that do not have consistent structures.
  • Maintain a working inventory of major regulatory, contractual, licensing, accreditation, and reporting obligations applicable to BCS programs and sites.
  • Coordinate compliance monitoring related to applicable OMH, OPWDD, NYC DHS, DYCD, DOE, housing, Medicaid, and other funder or regulatory requirements.
  • Monitor compliance with Justice Center incident reporting and Staff Exclusion List checks, Statewide Central Register (SCR) clearances, and mandated reporter obligations, in coordination with program leaders and Human Resources.
  • Support programs in preparing for audits, licensing reviews, funder monitoring, corrective-action follow-up, and external inspections.
  • Monitor completion of contract certifications, required reports, procurement disclosures, city monitoring requirements, and NYC system-related obligations, including PASSPort prequalification and the Charities Bureau CHAR500 annual filing, in coordination with responsible departments.
  • Monitor compliance with federal Uniform Guidance (2 CFR 200) and single audit requirements in coordination with Finance.
  • Maintain a tracker for audit findings, monitoring findings, corrective actions, responsible owners, deadlines, evidence of correction, and closure status.
  • Identify repeat findings and systemic concerns and recommend changes to staffing, training, policies, systems, or controls.

Medicaid Compliance

  • Develop, implement, and maintain a comprehensive Medicaid compliance program to prevent, detect, and address fraud, waste, and abuse in accordance with applicable requirements under New York State Social Services Law §363-d and 18 NYCRR Subpart 521-1.
  • Serve as BCS’s designated Medicaid compliance officer and lead the compliance committee required under 18 NYCRR Subpart 521-1.
  • Ensure and strengthen compliance with and understanding of confidentiality and privacy requirements, including HIPAA, 42 CFR Part 2, NYS Shield Law, OMH requirements, and NYC privacy laws.
  • Develop written policies, standards of conduct, and procedures addressing compliance expectations, reporting, investigations, disciplinary standards, and non-retaliation.
  • Design and conduct risk-based reviews of service documentation, billing support, eligibility, authorization, and other applicable Medicaid risk areas.
  • Establish and verify exclusion-screening procedures, including OIG, OMIG, and SAM checks at least every 30 days for staff, Board members, vendors, contractors, and other applicable affected individuals.
  • Coordinate required provider compliance attestations and maintain supporting evidence.
  • Complete and document the annual compliance-program effectiveness review.
  • Coordinate identified overpayment review, reporting, repayment, and corrective action with Finance and counsel.

Confidential Reporting and Investigations

  • Establish and publicize confidential reporting channels, including an anonymous hotline or equivalent reporting method.
  • Maintain an intake and investigation log and written procedures for triage, investigation, referral, corrective action, and closure.
