PRIVACY NOTICE FOR JOB APPLICANTS (CANDIDATES)

Persistent Systems Limited and its affiliates ("we", "our", "us") are committed to protecting the privacy and security of your Personal Data, which means any information that identifies or can reasonably be used to identify an individual. It is important that you read this Privacy Notice ("Notice"), together with our Privacy Policy ("Policy"), so that you are aware of how and why we are using such Personal Data.
1.1Purpose: This Notice describes how we process your Personal Data, during and after your job application with us, in accordance with the Indian Digital Personal Data Protection Act, 2023, General Data Protection Regulation (GDPR), California Consumer Protection Act (CCPA), under the guidance of ISO 27701 Privacy Information Management System (PIMS) and other applicable data protection laws and regulations.1.2Applicability: It is applicable to all job applicants. This Notice does not form a part of any contract of employment or other contract to provide services. We may update this Notice at any time, and the updated Notice will be available to each job applicant through their candidate account on the job portal. Any such updated Notice shall be binding on the candidate from the date of its publication on the job portal.1.3Relationship: We are the "Data Controller/Fiduciary" under the privacy requirements. This means that we are responsible for deciding how we process your Personal Data . As your prospective employer, we need to process information about you for normal employment purposes including recruitment and on-boarding. Processing will include collection, recording, organisation, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure by transmission, erasure, or destruction of your Personal Data. The data we hold, and process will be used for management and administrative purposes only. We will keep and use it to enable us to run the business and manage our relationship with you effectively, lawfully, and appropriately, whilst you are a job applicant, or working for us, at the time when your employment ends, and for an appropriate period thereafter. This includes using your Personal Data to enable us to comply with the employment contract, to comply with any legal requirements, pursue our legitimate interest and protect our legal position in the event of legal proceedings. If you do not provide your Personal Data or request for the deletion of data shared, we may be unable in some circumstances to comply with our legal obligations, and we will tell you about the implications of that decision.
2.Your Personal Data That We Will Process:
We may process the following categories of Personal Data about you:

"Personal Details", including but not limited to your name, address, date of birth, gender, and contact details, including email address and telephone/mobile number, citizenship, nationality, photograph.b. "National ID Details", including but not limited to driver's license details, passport number,c. "Current Employment Details" including but not limited to information about your current level of remuneration, including benefit entitlements.d. "Recruitment Information", including but not limited to copies of right to work documentation, details of your qualifications, skills, experience, employment history, work permit (if applicable), Income/Withholding Tax Certificate, Unemployment Insurance Certificate, Pension and Health Insurance, Local Tax/City Tax details.e. "Background check report" including but not limited to previous employment references and feedback, relieving letters, etc.f. "Image/video" via closed-circuit television (CCTV) system (if applicable)g. Video recordings of interviewsh. Interview assessment and scores, feedback from the interviewer about the discussion he/ she had with you about specific job application.i. Any other data the candidate may voluntarily provide.
We may also process the following "special categories" of more sensitive Personal Data:
j. Information about your health, including blood group, disability details, any medical condition, health, and sickness records/certificates (if applicable).k. Biometric data (if applicable)l. Criminal recordsm. Details of trade union membershipn. Ethnic origin, sexual orientation, religion, or beliefso. When you apply through our website or use our digital recruitment (including interview conducting & management) tools, we may collect limited technical data, such as your:
During the recruitment process, we may collect your Personal Data through the job application, CVs or resumes, interviews, identification documents, assessments either directly from you, or sometimes indirectly through third party service providers, publicly available sources (such as Naukri, LinkedIn, indeed, etc.). We may also collect your data through referrals provided by our employees. We may sometimes collect additional data from third parties, like medical clinics, job recruitment agencies, former employers, background check providers, as well as from other lawful sources not specifically listed here. We will collect additional Personal Data during the recruitment activity. All data collected during the recruitment process or additional data collected will be used and stored for performance of employment agreement as well as for complying with the applicable legal obligations.
We will only use your Personal Data where such use is permitted under the applicable law. The Personal Data you provide to us during the recruitment process will be used solely for purposes related to your job application and potential employment. Most commonly, we will use your Personal Data in the following circumstances:
a. Assess your qualifications and suitability for the job you applied for, including reviewing your CV, application, and any tests or interviews.b. Communicate with you about your application status, interview arrangements, and any other recruitment-related updates.c. Conduct background checks and reference verifications where applicable and with your consent.
a. Where processing is required to enter into a prospective employment or engagement contract with you-for example, to prepare and issue an employment contract.b. Where we need to comply with a legal obligation. (For example, it is required to check your entitlement to work compliance with the applicable labour laws, etc.)c. Where it is necessary for our legitimate interests (or those of a third party), provided that your interests and fundamental rights do not override those interests. For example, this may include carrying out selection process, or providing feedback to third party recruitment agencies regarding the status of a referred candidate's application, etc.d. Where we need to protect your interests (or someone else's interests)e. Where it is needed in the public interest [or for official purposes]f. Where we have sought your explicit consent.g. Where you have voluntarily provided Personal Data
6.If You Fail to Provide Personal Data:
If you fail to provide certain Personal Data when requested, we may not be able to process your job application.
7.Change of Purpose:
We will only use your Personal Data for the purposes for which we collected it. If we need to use your Personal Data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so without undue delay. Please note that we may process your Personal Data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by applicable laws.
8.Special Categories or Sensitive Personal Data:
Special categories or Sensitive Personal Data require higher levels of protection. We need to have further justification for collecting, storing, and using this type of Personal Data. We have in place an appropriate policy document and safeguards which are required by law to be maintained when processing such data. We may process special categories of Personal Data in the following circumstances:
a. Where we need to carry out our legal obligations or exercise rights in connection with employment.b. Where processing is necessary for the performance of contract to which you are a party.c. Where processing is necessary for the purpose of legitimate interest pursued by us or third party with appropriate safeguards.d. Where processing is necessary for the purpose of carrying out the obligations and exercising our specific rights and the specific rights of the employees, under the applicable laws relating to employment, labour, social security, and social protection, or any other applicable agreement or regulations that provide appropriate safeguards for your fundamental rights and interestse. Less commonly, we may process this type of data where such processing is necessary for the establishment, exercise, or defence of legal claims, to protect your vital interests (or those of another individual) where you are unable to give consent, or where the information has already been made public by you.
9.Data Sharing:
We will be sharing your Personal Data with the following recipients:
a. Third parties, interviews management platform/tool vendor (including AI Bots for conducting interviews), background check vendor, legal vendors (law firms), data shredding agency, referral management platforms We require third parties to respect the security of your data and to treat it in accordance with the lawb. Our other entities for performance of employment contract. We may transfer your Personal Data outside your home country for processing in accordance with appropriate contractual agreements such as Standard Contractual Clauses where applicable with our service provider/s.c. Internal departments, including with interviewers, recruitment team, hiring managers.d. We may also share your Personal Data when we must respond to court orders, or legal process, or to establish our legal rights or defense against legal claims. (Ex: to investigate, prevent or act regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, or as otherwise required by law)e. If we are acquired by, merged with, or undergo a reorganization involving another company, we may share your Personal Data with the acquiring, successor, or associated entity as part of that transaction, subject to applicable legal requirements and appropriate safeguards.
10.Cross Border Data Transfer:
As part of our recruitment process, your Personal Data may be transferred to and stored in countries outside your home country. This may include countries where our company offices, service providers, or partners are located.
However, to ensure that your Personal Data does receive an adequate level of protection we have executed appropriate contractual agreements such as Standard Contractual Clauses wherever applicable with our affiliates and service provider/s to ensure that your Personal Data is treated by those third parties in a way that is consistent with the applicable privacy laws.
11.Data Security:
We have put in place adequate measures to protect the security of your Personal Data.
Third parties will only process your Personal Data solely in accordance with our instructions and only after agreeing to maintain its confidentially and implement appropriate security measures. We do enter into specific agreements with such third parties to ensure compliance.
We have put in place procedures to deal with any suspected data security breach and will notify you and any applicable regulator of a suspected breach where we are legally required to do so.
12.Data Retention:
We will retain your Personal Data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. In some circumstances we may anonymise your Personal Data so that it can no longer be associated with you, in which case we may use such information without further notice to you. Once your Personal Data is no longer required, we will securely destroy it in accordance with our Data Governance Policy or applicable privacy laws and regulations.
13.Data Protection Officer:

14.Your Duty to Inform Us of Changes:
It is important that the Personal Data we hold about you is accurate and current. Please keep us informed if your Personal Data changes during your working relationship with us.
15.Rights Available to You:
Your rights in connection with personal data: Under certain circumstances, and only where such rights are provided under applicable law, you have the:
a. Right of access to your Personal Data (commonly known as a "data subject access request"). This enables you to receive a copy of the personal data we hold about you.b. Right to rectify the Personal Data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected.c. Right to be informed about the collection and use of Personal Data.d. Right to object to Processing of your Personal Data where we rely on a legitimate interest (or those of a third party), and there is something about your situation which makes you want to object to processing on this ground. You also have the right to object where we are processing your personal data for direct marketing purposes.e. Right to request the restriction of processing of your Personal Data. This enables you to ask us to suspend the processing of your Personal Data for example, if you want us to verify its accuracy or the reason for processing it.f. Right of data portability/ transfer to another party.g. Right to withdraw consent for processing of Personal Data where explicit consent has been sought. In the limited circumstances where you may have provided your consent to the collection, processing, and transfer of your Personal Data for a specific purpose, you have the right to withdraw your consent for that specific processing at any time. To withdraw your consent, please contact the Data Protection Officer. Once we have received notification that you have withdrawn your consent, we will no longer process your data for the purpose or purposes you originally agreed to, unless we have another legitimate basis for doing so in law.h. Right to Erasure of your Personal Data. This enables you to ask us to delete or remove Personal Data where there is no good reason for us continuing to process it.i. Right related to automated decision-making including profiling: You have the right not to be subject to a decision that is made solely through automated processing including profiling if it has a significant impact on you. We will only make such automated decisions when they are necessary to enter into or perform a contract with you, required by applicable law, or when you have given us your explicit consent as per applicable lawsj. Right to grievance addressal: You have right to grievance redressal in respect of any act or omission regarding the performance of obligations in relation to your Personal Data.k. Right to nominate: You have right to nominate, any individual who shall, in the event of your death or incapacity, exercise the rights on your behalf, as per applicable lawsl. Right to contact your local data protection authority: If you have concerns with our protection of your Personal Data, you can register a complaint with your local data protection authority, subject to the applicable privacy laws.
All the above-mentioned rights, excluding the right described in clause, can be exercised by contacting the Data Protection Officer at privacyofficer@persistent.com and will be evaluated based on the legal requirements, as applicable on the date of receipt of request from you. These data subject rights request will be applicable to data subjects as per the applicable privacy laws.
i. We will acknowledge your request/grievance within 72 hours and address your request within the timeframe as per applicable laws from the date of receipt of the requestii. Please note that we may ask you to verify your identity before responding to such requests. No Fee Usually Required:iii. You will not have to pay a fee to access your Personal Data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request for access is clearly unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances.
16.Changes to this Notice:
We reserve the right to update this notice at any time, and we will provide you with a new Notice when we make any substantial updates. All updates shall be effective and binding as of the date of such update. We may also notify you in other ways from time to time about the processing of your Personal Data.
