Job Purpose & Position Overview
Prepares and maintains case folders on all new adult criminal and juvenile criminal charges filed by the Tribal Prosecutor. Attends court hearings, arraignments and trials to assist the judge as needed; and records court proceedings. 
 
Specific Job Duties/Responsibilities:

• Demonstrates the Winnebago Tribe’s core mission, vision, and values.
• Answer all inquiries to the Tribal Court offices, both in person and over the telephone. Directs caller to the appropriate staff member for resolution.  
• Prepares case folders on all new charges file by Prosecutor/Presenting Officer, secure all documents as filed by parties, attorneys, and litigants. 
• Prepare files for court. All current documentation is filed and updated on the docket sheet.
• Prepares daily docket of cases to be called.
• Attends hearing, arraignments and trials, to assist the judge as needed and records minutes of court proceedings.
• Per written instruction from Prosecutor, Attorneys, litigants, or Judge, prepare and issue all case related materials, including warrants, subpoenas, summons and hearings notices. Responsible for witness management including jury selection and notifications.
• Prepare and maintain all active/pending case folders in an orderly fashion.
• Attempt to notify all parties concerned regarding postponements, cancellations, and rescheduling of court activities by telephone, mail, or personal service if time allows.
• Post, file, and route all court documents. Type court orders and judgments make appropriate distribution.
• Secures information for judges. Contracts witnesses, attorneys, and litigants to obtain information for the court.
• Maintains logs so that they are current and updated: warrant list, court process log, traffic log, bond log, master file log, and other established logs.
• Assign case numbers, maintain court docket and cross reference systems.
• Records arrangements for payment of court fees. Accepts monetary payments for filing fees, fins, bond, child support, restitution, and any other established fees that may be paid at the court; prepares a receipt for payer.
• Ensure all appropriate parties are notified of court judgments.
• Prepare cases for closure, ensure files are complete.
• Takes written complaints, petitions, and any other filings; as appropriate. Will attest to and certify court documents. 
• Will notarize signatures on a regular basis.
• Maintain master court calendar, make entries as appropriate and keep the calendar current.
• May be required to work after normal business hours, weekends, and holidays to take cash bonds from or for incarcerated individuals, to provide information for police from files or to contact available judges on certain situations. May need to accompany police or probation officer when a prisoner is in route to or from jail. 
• Must be familiar with all areas of the court and filing systems of all case files (forms, different procedures, etc.) to ensure case flow and back up when other clerks are out.
• Answer telephone greet public in a positive manner. Provides information on cases, as appropriate.
• Receive and distribute all incoming judicial correspondence; screen judicial calls and take messages as required.
• Will maintain confidentiality of all clients records as provided by law.

Required Qualifications/Skills:

• The ability to maintain the utmost confidentiality of all client’s files as provided by the law.
• Keyboarding abilities of at least 55 WPM with accuracy.
• Proficient in the use of word processing and database software.
• Must possess the ability to work with all the personalities of people who call on the court.
• Must possess a good command of the English language, both orally and whitens.
• Must qualify to be bonded.
• Dependability not only regarding being at work and on time but also in following through on all assignments and unsupervised work projects.
• Ability to assume the duties of other clerks, as needed.
• Must follow the Court of Ethics established for all Winnebago Tribal Court Personnel. 

Education Preference:  

• High School Diploma or G.E.D. is required
• Associate degree, or working towards a degree is preferred
• At least 1 year of experience is preferred

Supervisory Responsibilities:   

• None

Training Requirements:   

• Must possess current or be willing to obtain the Tribal Court Clerk certification within the first year of hire. 
• Must be a Notary Public Licensed in the State of Nebraska or be able to obtain a license.

Physical Requirements:

• Normal to light office work which includes the ability to lift up to 10 lbs.
• Regularly required to walk, stand, and sit for extended periods of time and use hands to operate computer keyboard, phone, and various office equipment.
• While performing daily duties, the employee is regularly required to talk and hear.

 Language Requirements:

• Must possess the ability to read, write, and speak the English language fluently.
• Must be able to continually and effectively employ professional verbal and written communications skills.
