Counsel - Marketplace Payments

San Bruno, CA | Sunnyvale, CA | Bentonville, AR

Walmart is building the next generation of commerce, payments and financial services at global scale. We are looking for a Counsel - Marketplace Payments to help build it.

This is not a traditional retail legal role. You will work alongside Product, Engineering and business teams building payments, seller financing, cross-border money movement and emerging financial products for one of the world's largest marketplaces.

You will also help tackle what comes next. Walmart is investing heavily in AI-powered and agentic commerce, from our own shopping assistant, Sparky, to collaborations with leading AI and technology companies. As AI changes how customers discover, shop and transact, you will help shape the payments and financial-services infrastructure that makes those experiences possible.

We are looking for a lawyer who wants to build, not just advise: someone who is curious about how products work, comfortable with novel legal questions, and excited to help turn ambitious ideas into products that can operate responsibly at Walmart scale.

What you'll do

  • Serve as a trusted legal advisor to Walmart Marketplace teams developing and operating financial-services and payments products for sellers, including merchant cash advances and other commercial-finance products, domestic and international payments, payouts and settlement.
  • Partner closely with Product and Engineering teams throughout the product lifecycle, helping design scalable products and translating complex legal and regulatory requirements into practical product and operational solutions.
  • Help Walmart navigate emerging legal and regulatory questions at the intersection of AI, commerce and payments as shopping evolves toward increasingly agentic experiences.
  • Advise on payment and financial-services issues arising from AI-enabled and agent-led commerce, including transaction authorization, payment credentials and tokenization, authentication, funds flows, data sharing, allocation of responsibility among participants, and interactions among customers, sellers, platforms and AI agents.
  • Work with technology and product teams on emerging commerce models in which Walmart's own AI capabilities and third-party AI platforms interact with Walmart Marketplace, payments and checkout infrastructure.
  • Advise on U.S. and international payments regulation, including money transmission and remittance requirements, ACH and NACHA rules, card-network rules, AML/CTF, OFAC and sanctions requirements, and related financial-services regulation.
  • Advise on commercial lending, sales-based financing, secured transactions, loan-brokering and other commercial-finance regulatory issues.
  • Analyze funds flows, settlement structures, payout mechanics, returns and chargebacks, collections and recovery strategies, and related operational and credit-risk frameworks.
  • Draft and negotiate complex agreements with sponsor banks, capital providers, payment processors, networks and other financial-services and technology partners.
  • Help evaluate new and emerging payment and commerce technologies, including digital wallets, tokenization, real-time payments, AI agents and other technologies that may change how customers discover, select and pay for products.
  • Identify legal and regulatory issues early in product development and work with business partners to develop pragmatic, risk-based paths to launch.
  • Develop scalable legal guidance, playbooks and processes that allow Marketplace payments and financial-services products to grow efficiently in the United States and internationally.
  • Partner across Legal, Compliance, Ethics, Privacy, Finance/Treasury, Risk and Technology and manage outside counsel on specialized regulatory, licensing and commercial-finance matters.

What you'll bring

Minimum qualifications

  • J.D. from an accredited law school and active membership in good standing in at least one U.S. jurisdiction.
  • 4+ years of legal experience involving payments, fintech, banking, commercial finance, lending or financial-services products.
  • Experience advising businesses on complex legal or regulatory issues and translating those requirements into practical business solutions.
  • Experience drafting and negotiating sophisticated commercial agreements.
  • Strong judgment, intellectual curiosity and the ability to operate independently in a fast-moving environment.
  • Ability and interest in working directly with product, engineering and business teams and understanding the operational and technical mechanics of the products you support.
  • Curiosity about emerging technologies and an interest in helping develop legal frameworks for products and business models that may not fit neatly within existing rules or precedent.

Particularly valuable experience

Experience in some combination of the following would be valuable, but we do not expect candidates to have experience in every area:

  • Payments regulation, money transmission, ACH/NACHA, card-network rules, payment processing or bank partnerships.
  • Marketplace, platform or embedded-finance products.
  • Merchant cash advances, commercial lending, factoring, invoice financing or other forms of seller or small-business financing.
  • Funds-flow analysis, payout orchestration, settlement mechanics, chargebacks or payment operations.
  • Cross-border payments or international payments and financial-services regulation.
  • Sponsor-bank, processor, payment-network or financial-infrastructure agreements.
  • Product counseling at a fintech, payments company, financial institution, marketplace or technology company.
  • Working directly with Product and Engineering teams on new financial products or technology.
  • AI-enabled products, agentic commerce, digital wallets, tokenization, real-time payments or other emerging commerce and payment technologies.

You do not need to check every box. We are particularly interested in lawyers who are curious about how financial products and emerging technologies work, enjoy solving novel problems, exercise strong business judgment and want to help build the next generation of payments, financial services and AI-enabled commerce for Walmart Marketplace.
