JOB SUMMARY
Attorney II
Performs moderately complex legal work including research, drafting, litigation, municipal prosecution, and counsel to the County and/or County officials.
ESSENTIAL JOB FUNCTIONS
- Legal Research & Counsel: Assists and conducts moderately complex legal research; drafts and/or prepares, under some supervisory review, written/oral legal opinions for departments and officials.
- Legal Correspondence: Drafts and prepares correspondence with opposing counsel, inquiries from the public, and correspondence from departments and officials, with some supervisory review.
- Contract/Legislative Drafting: Drafts, reviews and/or redrafts contracts, resolutions, executive orders, legislative orders, County Council rules of procedure and ordinances.
- General Litigation: Represents and/or assists in the representation of the County in civil and municipal trial and appellate court proceedings and administrative hearings; drafts and files, under some supervisory review, pleadings, memoranda, briefs, and motions; attends court and/or administrative appearances, and handles subpoenas, depositions and discovery requests; prepares and/or assists in the preparation for trial.
- Municipal Prosecution: Reviews traffic, criminal, code and animal violations issued by the local issuing authority, issues or refuses charges, and prosecutes cases to disposition
- Land Use Matters: Reviews and addresses matters related to planning, zoning, subdivision controls, and county codes related to erosion and settlement controls and flood damage prevention, and variances/deviations from county code.
- Condemnation Proceedings: Reviews and addresses matters in condemnation proceedings under Chapter 523, RSMo., and the Uniform Relocation Act, and regarding acquisitions generally under supervisory review; prepares the needed Bills and documents needed to proceed with the exercise of eminent domain through condemnation proceedings and prosecution of condemnation actions in Circuit Court, under supervisory review.
- Negotiation and Settlements: Negotiate plea agreements; assist in civil settlements consistent with policy and in the best interest of the County.
- Mental Health Detention Hearings: Represent local hospitals in involuntary mental health detention hearings.
- Professional Development: Maintain CLE compliance..
The individual in this role is expected to contribute to the team's efforts by completing other related tasks, as may be assigned.

EDUCATION AND EXPERIENCE - The following are the minimum education and experience required for the position. An equivalent combination of education, training and experience may be considered.

- Admission to practice law in the State of Missouri; active member in good standing with the Missouri Bar.

- Knowledge of municipal/government law (both transactional and litigation), property tax collections, quiet title, real estate, land-use matters, building and housing codes, sovereign and official immunity law, election law, condemnation actions, county finance and budget law, urban development law, contract law, employment law, probate matters and the Sunshine Law.
- Skill in drafting pleadings, motions, briefs, ordinances, resolutions, executive orders, legislative orders, contracts, memoranda, and legal opinions.
- Ability to prosecute municipal cases and represent the County in civil litigation and administrative hearings, to include cases at the trial and appellate levels.
- Knowledge of courtroom rules of evidence and procedures.
- Ability to conduct negotiations and settlements effectively.
- Skill in legal research using primary and secondary sources.
- Ability to manage multiple legal issues for different departments and officials.
- Knowledge of the Missouri Rules of Professional Conduct for attorneys.
- Skill in communicating moderately complex legal concepts clearly to departments and officials.
- Ability to meet deadlines.
- Knowledge of the Charter, the County Council Rules of Procedure and the Jefferson County Code.
- Ability to collaborate with courts, law enforcement, public officials, departments and department heads.
- Skill in legal risk identification and mitigation for the County.
- Ability to collaborate and brainstorm with other attorneys.
- Ability to mentor and cross_train less_experienced attorneys.

WORK ENVIRONMENT or atmospheric conditions commonly associated with the performance of the functions of this job.
- Office and courtroom settings; may require travel to hearings, meetings, and/or evidentiary/property viewing; moderate stress due to deadlines and demands on time.
- May require early morning or late evening hours.
- Work may require the ability to drive and/or operate a vehicle.
- May occasionally be exposed to uncomfortable temperatures, humidity, noise, chemicals/gases, contagious diseases, and airborne particles/pathogens.
