Acts as a legal adviser and attorney for the state/territory National Guard, responsible for the formulation of state/territory legal policy and its execution legal representation; legal initiatives; interpretation and litigation of U.S. and state/territory(s) constitutional, civil, criminal, labor law; international law and treaty agreements; and a full spectrum of expert legal advice. Responsible to advise on the legal, factual and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted, sensitive and emotionally charged issues relating to sexual assault/harassment and domestic violence/abuse. Serves as the state/territory National Guard litigation point of contact. Represents the state/territory National Guard in all legal matters in state/territory and Federal courts of original or appellate jurisdictions. Serves as an attorney/adviser providing acquisition and fiscal legal advice to the state/territorys assigned United States Property & Fiscal Officer, particularly in the area of emerging requirements in victim support and legal resourcing (the Chief of the National Guard Bureaus agent in the state/territory) and active-duty military advisers. Acts as the Adjutant Generals representative in third-party proceedings under Federal labor management and equal employment opportunity statutes and regulatory provisions. Serves as the state/territory Ethics Adviser. Reviews sensitive financial disclosure statements for General Officers and other key personnel. Performs other duties as required.

  • Incumbent must be an active member of the bar in good standing in Colorado, or in a state or territory of the United States and eligible to be admitted to the Colorado bar within six months of hire date.

  • Must be a graduate of an ABA-accredited law school.
  • This position is covered by the Domestic Violence Misdemeanor Amendment (30 Sep 96) of the Gun Control Act (Lautenberg Amendment) of 1968. An individual convicted of a qualifying crime of domestic violence may not perform the duties of this position.
  • Ability to establish effective professional working relationships with coworkers and customers, contributing to a cooperative working environment and successful accomplishment of the mission.
  • Irregular and/or overtime (compensatory) hours may be required to support operational requirements or contingencies or may be required to work hours outside of the normal duty day.

Qualifications

Must have experience or knowledge in each of the following:

  1. At least 24 months work experiences as a professional Attorney Advisor.

  2. Experience collecting and analyzing data effectively, efficiently, and accurately.

  3. Experience or knowledge of military and civilian laws, directives, regulations, policies, and procedures.

  4. The ability to clearly enunciate English without impediment of speech that would interfere or prohibit effective communications & write English in reports and presentation formats.

  5. Experience in interpersonal communications, empathy, and effective listening.

  6. Experience in communicating -orally and in writing- clearly and effectively.

  7. Experience organizing thoughts, research materials, and manage case projects; and skilled in comprehending and interpreting directives and laws.

  8. Knowledgeable of the Army National Guard and Air National Guard mission requirements

  9. Competent in providing legal interpretation and guidance to managers and senior leaders on 10 United States Code, and the state equivalent to the federal Uniform Code of Military Justice.

  10. Experienced in researching and providing legal advice in all functional areas of Administrative, Labor, Medical and Physical Disability, and Ethics Law.

  11. Experienced in developing and providing solutions to conflicting or contradictory DoD regulations, directives, and policies, and other NGB or state legal guidance.

  12. Experienced in preparing memoranda of reports that outlined and analyzed the factual and legal issues and have experiences involved preparing legal documents or advisory opinions, participated in contract negations, and examined documents for legal sufficiency.

Education

You must meet the following Education requirement to qualify for this position: Bachelor of Laws or Juris Doctor degree in law issued by an ABA- accredited law school; and must be admitted to practice law in Colorado, or eligible to be admitted to the Colorado bar within six months of hire date..

The Army, as one of the three military departments (Army, Navy and Air Force) reporting to the Department of Defense, is composed of two distinct and equally important components: the active component and the reserve components. The reserve components are the United States Army Reserve and the Army National Guard.

Regardless of component, the Army conducts both operational and institutional missions. The operational Army consists of numbered armies, corps, divisions, brigades, and battalions that conduct full spectrum operations around the world. The institutional Army supports the operational Army. Institutional organizations provide the infrastructure necessary to raise, train, equip, deploy, and ensure the readiness of all Army forces. The training base provides military skills and professional education to every Soldier—as well as members of sister services and allied forces. It also allows the Army to expand rapidly in time of war. The industrial base provides world-class equipment and logistics for the Army.
