    JOB SUMMARY

    Serves as internal consultant and advisor for Equal Employment Opportunity (EEO) and Americans with Disabilities Act (ADA) and serves as Title IX Coordinator. Plans, organizes and supervises Title IX and EEO/ADA Compliance functions within Human Resources. Provides advice on matters related to equal opportunity. Advises on system-wide issues involving compliance with internal discrimination and disability policies, procedures, and practices; consultations on matters that implicate federal, state, and local discrimination and/or disability laws; evaluations and investigations for allegations of discrimination and harassment made by employees and/or students, against AACPS employees; investigations of discrimination charges filed with the Equal Employment Opportunity Commission (EEOC), Office of Civil Rights (OCR), and/or other Fair Employment Practices Agencies (FEPAs). Develops and delivers discrimination and harassment training regarding, as needed.

    ESSENTIAL DUTIES/RESPONSIBILITIES

    • Manages complaints of discrimination and harassment from intake to resolution. Researches, interprets, and provides advice of counsel, legal representation, drafts and submits written testimony, prepares legal briefs and other correspondence in dispute matters.
    • Monitors, reviews, and advises on internal equal employment opportunities and compliance issues such as allegations of employment discrimination based on protected classes in Title VI, Title VII, ADA and other laws, Board policies, and regulations that prevent discriminatory practices in hiring or employment. Obtains statements and affidavits.
    • Oversees ADA reasonable accommodation process. Reviews requests, makes decisions and recommendations, and manages provisions. Consults on employee fitness-for-duty, workers' compensation, and complex disability matters. Oversees compilation and maintenance of records pertaining to discrimination, harassment, and medical concerns. Conducts special investigations, as directed.
    • Oversees EEO inquires, including investigations, investigative reporting, and resolution communications to parties. Performs analytical evaluative, interpretative and advisory duties to ensure completion of responsibility for internal EEO program compliance.
    • Conducts investigation of equal employment opportunity and Title IX complaints, determines investigative methods to be used, interviews complainants, respondents, witnesses and other individuals, conducts site visits, reviews records and prepares fact finding reports and provides alternative resolutions and recommendations.
    • Identifies training needs and develops and provides system-wide training for supervisors and employees on EEO, ADA, and harassment related issues. provides guidance to staff, drafts and reviews related regulations and internal processes and procedures. Ensures appropriate training is provided to principals, managers, and other staff regarding investigatory policies and procedures.
    • Prepares for and participates in EEOC and Maryland Commission on Civil Rights (MCCR) hearings; conducts research on law and government-issued guidance pertaining to discrimination and harassment.
    • Assists the Executive Director of Human Resources as needed.
    • Advises principals and managers, in consultation with the Executive Director of Human Resources, regarding employee equity issues and provides legal advice regarding various human resources issues as needed.
    • Attends Board of Education meetings and provides advice on legal implications of actions taken, as needed.
    • Performs other related duties as assigned within the same classification or lower.

    MINIMUM QUALIFICATIONS

    Education

    • Bachelor''s Degree in applicable field of education from a regionally accredited college or university required.
    • Juris Doctorate from a regionally accredited college or university law school preferred.

    Experience

    • Six (6) years progressively responsible experience in the areas of EEO/ADA Compliance required.
    • Three (3) years experience in conducting employment-related investigations required.
    • Professional experience as an attorney in court, administrative proceedings, and trials preferred.

    Knowledge, Skills, Abilities and Other Characteristics

    • Knowledge of K-12 public school organization and operation is preferred.
    • Demonstrated experience and skill in independently investigating employee misconduct and drafting investigative findings, inclusive of the ability to analyze relevant statistical information, interview parties and witnesses, and write coherent reports.
    • Knowledge of laws and regulations regarding general employment practices such as the Civil Rights Acts, Americans with Disabilities Act, Family and Medical Leave Act and Laws and regulations of the state of Maryland regarding Unemployment Compensation, and teachers' and children's rights.
    • Knowledge of federal, state, and local EEO laws.
    • Excellent written and verbal communication skills.
    • Ability to analyze legal issues, facts, evidence and precedents in highly complex legal documents and instruments.
    • Ability to effectively prepare contracts, other legal instruments and court presentations.
    • Demonstrated ability to effectively work and communicate with diverse populations.
    • Demonstrated proficiency with business technology applications (e.g. Video/Web Conferencing, Microsoft Office Suite -Word, Excel, Outlook, and/or PowerPoint preferred).

    Licenses and Certifications

    Employee must retain active licenses, certifications, and enrollment as a condition of employment.

    • Hold or be eligible for Driver''s License (DL) Class C Non-Commercial issued by Maryland or State of Legal Residence (MVA/DMV) required; and
    • Daily access to reliable transportation.
