We are seeking an experienced and dedicated Plaintiff’s Personal Injury Attorney with specialized expertise in catastrophic & complex trucking and fleet vehicle litigation. As a key member of our team, you will lead and control a diverse, high-impact caseload from initial intake through trial verdict. This role requires a mastery of the Federal Motor Carrier Safety Regulations (FMCSR) and DOT regulations; and demands a sophisticated legal mind and the ability to collaborate effectively with investigators, medical and industry experts.

Plaintiff Personal Injury Attorney

Location: Houston, TX

Compensation: $150K - $225K (DOE) + bonus eligible (settlement bonus, trial bonus, and referral bonus)

Core Responsibilities:
  • Forge the Path to Victory: Develop and execute comprehensive, high-stakes litigation strategies for every case.
  • Docket Management: Oversee, direct, and be responsible for a team of litigation attorneys, paralegals, and legal assistants to litigate a docket of complex, catastrophic personal injury cases.
  • Lead and Control: Manage all phases of trucking and fleet vehicle personal injury complex and catastrophic cases, including pleadings, discovery, depositions, motion practice, mediations, and trial.
  • Command the Negotiating Table: Conduct effective settlement negotiations to maximize client recovery, always prepared to push cases to a jury verdict.
  • Expert Collaboration: Work closely with technical experts and investigators to build strong, evidence-based cases.
  • Client Advocacy: Maintain clear, empathetic, and consistent communication with clients, guiding them through every step of the legal process.

Licensing & Experience
  • Licensed Attorney in Texas and in good standing with the State Bar.
  • Minimum of 5+ years of progressive experience in taking personal injury cases to trial.
  • Demonstrated focus on managing complex trucking and commercial vehicle cases.
  • Exceptional writing, negotiation, and courtroom advocacy skills.
  • Charismatic, determined litigator with a commanding courtroom and jury presence.
  • Must have significant first-chair trial experience.
  • Proven history of trying catastrophic injury cases.
  • Expertise in Texas Evidence, Procedural and Substantive law.
  • Strong litigation strategy and client advocacy skills.
  • Exceptional negotiations and jury communication skills.
  • Dedication to securing justice for clients affected by life altering injuries.

The Technical Gauntlet:
  • Deep Expertise Required We need an attorney who can speak the language of commercial transport and immediately dismantle a trucking defense. Your knowledge base must include:
  • Regulatory Mastery: FMCSA regulations, DOT compliance, and the minute details of Hours of Service (HOS) rules.
  • Liability & Corporate Veil: Profound understanding of vicarious liability (Respondeat Superior), negligent entrustment, and claims concerning negligent hiring, training, supervision, and retention.
  • Complex Insurance: Navigating MCS-90 filings, self-insured entities, excess/umbrella coverage disputes, and commercial insurance policies.
  • Jurisdictional Strategy: Command of intrastate vs. interstate trucking laws and jurisdictional considerations.
  • Vehicle & Cargo: Expertise in product liability, maintenance failures, cargo liability, hazardous materials (HAZMAT) transport, and load securement requirements.
  • Employment Law Overlap: Understanding of independent contractor vs. employee classification with FLSA implications.
