Position Summary
Phoenix Childrens is seeking an Assistant General Counsel with at least five years of healthcare law experience in a law firm or in-house legal department working successfully with hospitals or health systems. This position is responsible for ensuring Phoenix Childrens is in compliance with applicable laws, rules, and regulations. This position is responsible for drafting and reviewing contracts, including but not limited to:
• Physician employment agreements • Medical director agreements • Real estate leases • Equipment leases • Research agreements • Vendor and information technology contracts
Provides advice and guidance regarding compliance, medical staff issues, licensing, employment law, research, and business transactions. Familiarity with laws, rules, and regulations applicable to healthcare entities. Provides legal advice to clinical leaders, hospital staff, and committees on a wide range of patient issues, including interfaces with external regulatory agencies and patients/families.
Position Duties
• Advises the Hospital on regulatory compliance matters in conjunction with compliance and privacy officers, including as appropriate conducting or overseeing regulatory investigations. • Remains current on laws and advises clinical and operational leaders on compliance and enforcement matters and helps evaluate and develop options to address regulatory developments.
• Contributes to the achievement of established department goals and objectives and adheres to departmental policies and procedures.
• Oversees administrative functions relating to corporate filings, license renewals, and other miscellaneous documentation needs.
• Possesses a fundamental knowledge of major federal laws relating to healthcare, including but not limited to: • Fraud and abuse laws • Self-referral prohibitions (Stark Law) • EMTALA • HIPAA • Laws relating to tax-exempt organizations
• Develops a fundamental knowledge of analogous state laws applicable to the Hospital.
• Maintains and improves knowledge of these and other applicable laws, including laws regarding licensure, credentialing, and patient care issues.
Preparation of Documents
• Prepares document templates for recurrent use, standardizes contracts and forms, and drafts legal documents unique to specific needs.
Representation and Negotiation
• Represents the Hospital in negotiation of and prepares wide range of legal documents, including but not limited to: • Legal memoranda • Contracts • Transactional documents
• Seeks to improve legal drafting skills.
Research and Analysis
• Researches legal issues, identifies alternative courses of action and associated legal risks, and makes recommendations.
• Maintains current knowledge of industry and related legal/regulatory developments and communicates relevant information as appropriate to internal clients and the legal team.
• Reviews contracts and other legal documents for regulatory compliance and language unfavorable to the Hospital.
• Acts as clearinghouse for official notices and develops process for responding to subpoenas.
• Triages requests for legal assistance. Provides legal analysis, advice, and counsel to senior management and as appropriate to other employees on a wide range of legal issues affecting healthcare operations, medical staff, and patient care matters.
• Performs miscellaneous job-related duties as requested.
