Description

The City of Concord is seeking an attorney with at least 3 years of prosecution experience to serve as a Assistant City Prosecutor to assist with criminal cases in the City Prosecutor's Office. This position presents an excellent opportunity to join a highly collaborative team of prosecutors in a dynamic office serving the Capital City and surrounding towns.

JOB SUMMARY:

This position is responsible for the trial and disposition of criminal cases.

Examples of Duties

Prepares for and executes prosecution of violations, misdemeanors and felonies; reviews case merit with investigating officer; reviews case development with co-workers or outside agencies; renders opinion as to prosecutorial merit; advises officers as to charging options; reviews charging documents; files charging documents with the court; prepares plea bargains; conducts criminal arraignments; negotiates possible trial solutions with the defendant or defense counsel.

Reviews, evaluates, and responds to defense and pre-trial pleadings; researches, writes, and submits pre-trial pleadings; identifies expert witnesses required for pre-trial and trial proceedings; prepares witnesses for pre-trial hearings; conducts pre-trial hearings.

Prepares police officers for probable cause hearings; conducts probable cause hearings.

Prepares expert and lay witnesses, officers, and victims for trial; determines witness order; evaluates and determines the process of witness testimony.

Conducts trials; initiates interlocutory appeals during trial.

Answers media inquiries.

Conducts sentencing arguments; researches, writes, and submits post-trial pleadings; conducts post-trial hearings.

Prepares for and executes administrative hearings.

Prepares for and executes probate hearings, as assigned.

Provides legal training for law enforcement personnel; assists in the development of law enforcement policies and procedures, as assigned.

Prepares for and executes juvenile proceedings.

Coordinates with the Office of the County Attorney, State Attorney General, and federal executive agencies as appropriate to criminal proceedings.

Enters information into prosecutor database; copies documents; retrieves and re-files defendant case files.

Reviews domestic violence cases with the Victim Advocate.

May serve as computer system administrator.

Performs other related duties as assigned.

Typical Qualifications

Education and Experience:

Juris Doctorate. Experience in litigation through trial and appellate level; and one to two years progressively responsible experience; or, any combination of education, training and experience, which provides the knowledge, skills and abilities, required for the job.

Licenses and Certifications: Member of the State Bar Association, NH Drivers License

Permanent Part-Time Employees

Permanent Part-Time Employees are eligible for the following benefits:

Income Protection Plan

The Income Protection Plan is provided at no cost and includes a pro-rated sick leave program, Short-Term Disability Insurance, and Long-Term Disability Insurance.

Flexible Spending Accounts (FSAs)

FSAs can be set up for Health or Dental Care expenses and/or Dependent Care expenses, allowing an employee to set aside a predetermined amount of money on a pre-tax basis and be reimbursed for eligible expenses under the IRS code.

Annual (Vacation) Leave

Permanent Part-Time Employees accrue leave on a pro-rated basis. Annual leave cannot be used during an employees first six months of employment. The Personnel Rules & Regulations, departmental approval procedures, and/or any applicable collective bargaining agreement should be referred to for details.

Paid Holidays

Permanent Part-Time Employees are compensated 4 hours of holiday pay (half the compensation of a full-time employee) on City observed holidays. Subject to the terms of applicable collective bargaining agreements and/or the Personnel Rules and Regulations, employees generally observe 12.5 paid holidays each year.

NH Paid Family & Medical Leave (NH PFML)

Provides a 60% wage replacement (up to the social security wage cap) for up to six weeks per year (after an initial 7-day elimination period) for absences from work for covered common life events such as:

  • An employee's own serious health condition when disability coverage does not apply
  • An employee to bond with a child during the first year of birth, including placement for adoption or fostering
  • An employee to care for a family m ember with a serious health condition
  • Any qualifying urgent demand or need arising out of the fact that the employee's spouse, child or parent is a covered military member on covered active duty
  • An employee to care for a covered service member with a serious injury or illness if the employee is the service member's spouse, child, parent or next of kin

NH PFML will run concurrently with the federal Family and Medical Leave Act (FMLA) when the employee qualifies for both programs. If the employee is eligible for workers compensation, they will not qualify for PFML benefits for this same event. If the employee qualifies for Short-Term Disability, they will not qualify for PFML benefits for the same days absent. This leave can be used intermittently.

Merit Pay Plan

Permanent Part-Time Employees are eligible for a merit pay increase, typically one step on the applicable wage schedule, upon satisfactory completion of their probationary period and annually thereafter (again subject to satisfactory performance).

Employee Perks

Family Pool Pass for City Employees, Non-Concord Residents

Go to the Parks and Recreation office at 14 Canterbury Rd, show your work badge or picture id. This is a family pass but you must be the one to sign up initially. Parks and Recreation will confirm current employment on a roster. You will receive a specific color employee pass that you will use to gain entrance at all open City Pools and the Splash Pad.

Beaver Meadow Golf Course Guest of Member Rate

Employees will need to register with the Proshop to obtain a household account. Every employee will need photo ID, proof of employment (badge or paystub) and email address. Once they have completed that task, they will check in through our normal processes and receive the employee rate.

Concord Public Library Card for City Employees, Non-residents

Employees will need to go to any of the three branches to obtain a non- resident library card. You will need to bring photo identification and your name will be checked against the active employee roster. Once confirmed, your Concord Public Library card application will grant you full library usage while employed. The pass must be renewed and will be set to expire each August 31st of the current year.
