Description

The Attorney General is the chief legal officer of the State of Maryland. The Office of the Attorney General (OAG) has the general charge, supervision, and direction of the State’s legal business, acting as legal advisors and representatives of the major agencies, various boards, commissions, officials, and institutions of State Government. The OAG also protects the public by civil enforcement of antitrust, civil rights, consumer protection, and securities laws and regulations and by the prosecution of organized crime, Medicaid fraud, environmental crimes, insurance fraud, state tax evasion, and other ​​statutorily assigned matters. As Maryland’s 47th Attorney General, Anthony G. Brown leads the Office with a critical focus on equity, justice, and fairness.

The OAG is seeking an Assistant Attorney General to serve as Advice Counsel to the Family and Medical Leave Insurance (FAMLI) Division within the Department of Labor (DOL). DOL is a dynamic agency made up of several divisions, including Unemployment Insurance, Labor and Industry, Workforce Development and Adult Learning, Financial Regulation, Occupational and Professional Licensing, and the Racing Commission. The OAG provides comprehensive legal counsel and litigation support to all divisions, as well as to the Secretary and administrative units, on enforcement actions, disciplinary matters, defense litigation, and legislative and regulatory initiatives.

Advice Counsel is responsible for providing legal advice and representation on the State and federal laws and regulations administered by the Division, including the Maryland Family and Medical Leave Insurance Program (Md. Code Ann., Lab. & Empl. § 8.3-1001) and the federal Family and Medical Leave Act. Responsibilities also include advising on procurement, data-sharing, human resources, and benefits administration.

Key duties include providing formal and day-to-day legal guidance; reviewing, analyzing, and preparing legislation, policies, and regulations; assessing interactions between the program and ERISA and tax law; and supporting other assistant attorneys general on shared benefit-related issues. The role involves active participation in meetings and close collaboration with the Division’s staff.

Classification: Assistant Attorney General III

Experience: The ideal candidate will have at least five years of substantive legal experience and be admitted to the Maryland Bar or able to obtain admission promptly through waiver. The successful applicant will demonstrate strong professional judgment and the ability to operate independently while effectively coordinating with client leadership, program staff, and fellow members of the legal team. Candidates should bring exceptional written and verbal communication skills, strong organizational abilities, and advanced analytical thinking. A proven record of managing complex legal matters, balancing multiple priorities, and providing clear, practical guidance to clients is strongly preferred.

The Office of the Attorney General expects its attorneys to demonstrate a sustained commitment to pro bono service. Applicants should have a demonstrated record of meaningful pro bono engagement or a sincere interest in pro bono work as a professional obligation. Once hired, Assistant Attorneys General are expected to fulfill that commitment throughout their employment with the Office through active participation in OAG’s Stephen H. Sachs Pro Bono Program or other qualified opportunities. The OAG supports attorneys in meeting the goal set by the Maryland Supreme Court, MD Atty Rules § 19-306.1(b), by allowing up to 50 hours work-time to be used for approved pro bono activities.
