The Mike Hostilo Law Firm is seeking a LICENSED attorney with experience in obtaining approval of personal injury settlements in probate courts (for minors compromises, deceased individuals' survival claims), and claims of incompetent adults) and bankruptcy courts to support our high-volume personal injury practice in matters where federal bankruptcy law and Georgia probate law require oversight and approvals of certain personal injury settlements. Experience with structured settlements and pooled special needs trusts, and the companies that prepare such instruments, also a plus. This is neither a consumer bankruptcy practice nor an estate planning role. The attorney in this position will not manage independent Chapter 7 or Chapter 13 caseloads, draft wills, or build a standalone probate practice. The focus is narrow and procedural: protecting settlements, securing required court approvals, and ensuring compliance when bankruptcy or probate issues arise within active personal injury cases. You will serve as in-house counsel to our litigation and pre-litigation teams on all bankruptcy and probate matters relating to personal injury claims.
What This Role Handles
Bankruptcy matters connected to injury clients:
• Review intake and conduct PACER searches to identify active or prior bankruptcy filings
• Advise attorneys on disclosure obligations and risks
• Prepare and file motions to approve compromise/settlement
• File motions to reopen cases when required
• Coordinate with Chapter 7 and Chapter 13 trustees regarding settlement proceeds
• Ensure proper court authorization before disbursement Probate and estate matters arising from injury cases:
• Assist families of deceased clients to establish an estate when a client dies after representation has commenced, but not as a result of the tort giving rise to their claim. • Assist families of deceased clients to obtain Letters Testamentary or Letters of Administration
• Coordinate allocation between wrongful death proceeds and estate claims, as applicable.
• Handle minor settlement approvals in Probate Court
• Assist in the preparation and presentation of structured settlements for judicial approval
• Coordinate guardianship or conservatorship filings when required
What This Role Does Not Include
• General consumer bankruptcy representation unrelated to firm cases
• Ongoing Chapter 13 plan management
• Creditor defense work
• Estate planning, wills, or trusts unrelated to injury claims
• Building an independent probate practice
Qualifications
• Licensed and in good standing with the State Bar of Georgia
• Admitted to practice before the U.S. Bankruptcy Courts for the Northern, Middle, and Southern Districts of Georgia
• Experience filing and handling petitions on behalf of injury claimants in bankruptcy court
