Minimum Qualifications:

 

  • Bachelor’s degree with minimum of two years’ experience in a relevant field of Human Resources, Law, or Compliance OR a Master’s degree with at least one year of experience in Human Resources, Compliance or equivalent military compliance experience.
  • Demonstrated experience working with confidential matters
  • Demonstrated experience working with diverse populations
  • Digital literacy including Microsoft Office

 

Preferred Qualifications:

 

  • In-depth knowledge of higher education policy, laws, and trends related to Title IX, Title VI, ADA, and Affirmative Action.
  • Experience using Learning Management Systems (LMS)
  • Experience using de-escalation and mediation strategies
  • Professional experience preparing reports

 

General Function:

 

Under the direction of the Executive Director of Human Resources, the Compliance, Equity and Inclusion Officer is responsible for providing guidance to executives, faculty and staff relative to their rights, roles and responsibilities in the areas of compliance with federal and state laws as well as TBR and Motlow State policies and guidelines including, but not limited to: Equal Employment Opportunity (EEO), Title IX, Title VI, Title VII, Violence Against Women Act (VAWA), the Americans With Disabilities Act (ADAAA), Clery Act, Veterans Accountability, and the Family Education Rights and Privacy Act (FERPA).

 

The Compliance, Equity and Inclusion Officer provides educational programming on equity and diversity-related topics, and provides cultivation of mutual respect, acceptance, and understanding, and provides direction to the campus community to support and enhance the College’s commitment to diversity, equity, and inclusion.

 

The Compliance, Equity and Inclusion Officer provides written reports to TBR General Counsel and Motlow State executives regarding employee complaint investigations, and updates policies to ensure compliance with local, state, and federal laws.

 

Major Duties and Responsibilities:

  • Serve as the College’s Records Retention Officer.
  • Conduct complex employee complaint investigations and prepare complaint investigation reports including recommendations for corrective action when violations of college policies or departmental work rules occur.
  • Investigate disability claims lodged by college employees including determining if disability is covered under state or federal law, determining if accommodation requests are reasonable under state or federal law, advising departments on effective means of compliance with requests.
  • Coordinate the administration of FMLA for Motlow Community College, including development and administration of the school-wide policy, guidelines and procedures.
  • Work proactively and impartially with management and/or employees to resolve labor/management and interpersonal conflicts, disputes, and other types of misunderstandings expeditiously and informally.
  • Advise management and/or employees on their roles, rights and responsibilities under the citywide policies regarding anti-harassment and anti-discrimination, workplace violence prevention and ADAAA policies.
  • Monitor federal and state employment regulations, research and assess effects of new laws, changes and updates to existing laws on existing city policies, and recommend applicable changes in existing policies/procedures or new policies to the Executive Director of Human Resources.
  • Monitor and review all disciplinary action notices and follow up with departmental representatives as necessary.
  • Respond to Unemployment Compensation claims.
  • Review pre-employment background investigations and decisions.
  • Prepare statistical reports for management and elected officials and makes recommendations for action.
  • Prepare required State and Federal reports to the US Equal Employment Opportunity Commission, Office of Federal Contract and Compliance Programs, Veterans Administration, Tennessee Human Rights Commission, and the Tennessee Board of Regents.
  • Responsible for training sessions in-house or third-party on all compliance matters.

 

Knowledge, Skills, & Abilities:

 

  • Provides critical leadership and direction to the campus community in training and support of federal, state, local laws, TBR and College policy and guidelines.
  • Ability to analyze laws, regulations, policy and data.
  • Experience developing and delivering training across broad institutional lines on laws, policies and procedures.
  • Strong writing, communication, and interpersonal skills.
  • Experience using technology for reporting purposes.
  • Demonstrated commitment to the principles of equal opportunity, affirmative action, equity and diversity.

 

Physical Requirements/Working Conditions:

 

  • Traveling to various campuses to meet with employees and/or students as needed
  • Complete annual training to stay current on relevant policies and laws
