Consumer Lending Counsel

Buffalo, NY

FUNCTION:

Provide legal support to M&T Bank’s consumer lending business lines and products including direct lending origination and routine servicing (installment loans, overdraft lines of credit, credit card, and home equity lines of credit) and indirect lending origination and routine servicing (auto and recreational finance).

POSITION RESPONSIBILITIES:

Provide legal advice to business line on product development, operations, originations and routine servicing, including creating required customer facing agreements, documents and disclosures.  

Advise clients on applicability of federal and state consumer banking laws and regulations to products and services.

Advise consumer business line on legal matters relating to compliance with applicable state and federal laws and regulations such as the Truth in Lending Act, Equal Credit Opportunity Act, Electronic Fund Transfer Act, Fair Credit Reporting Act, and Bank Secrecy Act, as well as the regulations that implement those laws. 

Identify legal risks associated with supported business lines and products; collaborate with clients to develop plans to mitigate such risks with a view towards the risk appetite of the bank.  

Work cooperatively with the Compliance Department to keep current with all changes to laws and advise the business units of necessary changes in a timely manner.

Assist with responses to regulatory and customer complaints.

Work cooperatively with the business units and Compliance Department to facilitate the successful implementation of new products and services. 

Cross-functional collaboration with other departments within the Bank, including the Compliance Department, risk, oversight, and audit.

Research and analyze laws, rules and other legal developments, and describe how those matters affect products and services offered by the Bank.

MINIMUM QUALIFICATIONS REQUIRED:

J.D. Degree.

4+ years previous experience as a consumer attorney.

New York State or applicable state bar admission.

Thorough knowledge of personal computers and related departmental software programs.

Excellent verbal and written communication skills with the ability to interact with a variety of personnel. Strong analytical skills.

We encourage candidates with relevant military experience to apply.

IDEAL QUALIFICATIONS PREFERRED:

4 years of relevant work experience within a financial services legal division. 

Superior analytical and collaborative skills; ability to work independently. 

Strong substantive background with federal and state consumer financial services laws, and in particular, Regulation B (Equal Credit Opportunity), Regulation V (Fair Credit Reporting), Regulation Z (Truth in Lending) and UDAAP.
