Deputy Attorneys General, with critical support from criminal special investigators, victim service specialists, paraprofessionals, and administrative staff, prosecute criminal cases, enforce consumer laws, provide counsel to state agencies, ensure the public's access to open government, protect the abused, and much more.

Summary Statement

The Delaware Department of Justice is seeking a Deputy Attorney General (“DAG”) to join its Health Law Unit (“HLU”), Civil Division, to represent the Department of Health and Social Services (“DHSS”).

  1. Pay Grade A12 DAG I: Salary Range $75,684/min - $83,252/max
  2. Pay Grade A14 DAG II: Salary Range $87,822/min - $92,106/max
  3. Pay Grade A16 DAG III: Salary Range $96,997/min - $99,129/max
  4. Pay Grade A18 DAG IV: Salary Range $106,626/min - $108,737/max
  5. Pay Grade A20 DAG V: Salary Range $118,238/min - $122,920/max

Essential Functions

This Deputy Attorney General position will involve general counsel duties for the Delaware Psychiatric Center, Adult Protective Services, the Long-Term Care Ombudsperson, and the Delaware Nursing Home Resident Quality Assurance Commission, and representing DHSS in guardianship hearings filed on behalf of State agencies. In addition, the position also involves representing the State of Delaware in Weapons Relinquishment and Lethal Violence Protection hearings as well as performing other duties as assigned. The agency counsel duties involved in this position include the provision of legal advice, drafting and reviewing legislation and regulations, procurement law compliance, drafting and reviewing contracts, requests for proposals, and MOUs, Freedom of Information Act compliance, drafting Attorney General Opinions, representation of the agencies and/or agency officers and employees in court and administrative proceedings, providing legal advice regarding disability and employment law, applicable State and Federal statutes and regulations, including Title XIX of the Social Security Act (Medicaid), HIPAA, and CFR Part 2.

Job Requirements

The most qualified candidates will be proficient in health law, as well as have prior litigation and general counsel experience; however, such expertise and experience is not required for selection. The HLU takes a proactive approach to assisting its agency clients; therefore, a successful candidate should have the ability to work with State agencies to identify potential issues and assist State agencies to address such issues to minimize or avoid future legal action. This DAG should be able to work independently and meet deadlines, with demonstrated legal ability and thorough knowledge of relevant laws and court rules. Membership in Delaware Bar is required.
