The Federal Compliance Officer reports directly to the College President and will have the primary responsibility for ensuring the institution's compliance with all Federal, State and Local laws and regulations protecting equal opportunity in employment for all employees at the College and prohibiting discriminating based on protected status. The Federal Compliance Officer will also be responsible for maintenance of the College's Affirmative Action Plan, resolving complaints of discrimination internally at the College and externally before the Equal Employment Opportunity Commission and Maryland Commission on Civil Rights, and the review and determination of requests for accommodation pursuant with the American with Disabilities Act. The position will also be responsible for compliance with Title VII of the Civil Rights Act of 1964.
The Federal Compliance Officer will also fulfill the role of the Title IX Coordinator. The College's Title IX Coordinator will have the primary responsibility for the coordination of the College's efforts to comply with and carry out its responsibilities under Title IX of the Education Amendments of 1972, which prohibits sex discrimination in all the operations of the College as well as retaliation for the purpose of interfering with any right or privilege secured by Title IX. Job Duties and Responsibilities:
- Review on annual basis the Board of Trustees' policies and College's procedures relating to equal employment and non-discrimination laws to ensure they are current and comply with applicable laws. Attend professional development conferences and training relating to the laws within the purview of the Federal Compliance Officer.
- Responsible for the investigations and judication of allegations of discrimination filed internally pursuant to Board of Trustee's policies and the College's procedures and externally with the Equal Employment Opportunity Commission and the Maryland Commission on Civil Rights.
- Respond to any inquiries and/or directives from the Department of Education. Provides sufficient oversight to ensure the College maintains equal opportunity for all its employees and is in compliance with all applicable non-discrimination laws. Establishes and oversees the assurance of compliance to implement policies and procedures related to the Americans with Disabilities Act, Section 504 of the Rehabilitation Act of 1973, Title XII of the Civil Rights Act and the Lily Ledbetter Equal Pay Act of 2009.
- Develop a process to uncover and identify compliance vulnerabilities and correction action plans to remediate. Exercise the primary responsibility for coordinating the College's efforts to comply with and carry out its responsibilities under Title IX of the Education Amendments of 1972 to include the supervision of the Title IX Investigator.
- In collaboration with the Chief Diversity Officer and the Vice President for Learner Support Services prepare, keep current and disseminate materials to the college community regarding their rights and responsibilities under Title IX. Review, investigate and approve all requests for employee accommodations. Work with Human Resources when necessary to make an informed decision.
- Ensure that the College website and all other forms of communication to the college community regarding equal opportunity and non-discrimination are periodically reviewed and kept current with applicable College policies, procedures and applicable laws.In collaboration with the Chief Diversity Officer and Human Resources develop and provide educational trainings for College employees regarding equal opportunity, non-discrimination, sexual assault and harassment and Violence Against Women Act.
- Responsible for development, review and analyzing the affirmative action data. Keep current the College's Affirmative Action Plan.
- Provide recommendations to College leadership for action plans and when approved, in collaboration with Human Resources, implement said plans. Supports the general counsel on College matters, as requested. Provides advice on legal matters in support of college operations, which may include employment law, real estate, contracts, etc. Other duties as assigned.
- A minimum of 10 years of experience with compliance program development, implementation, complaints and investigations. This includes at least 2-4 years of higher education or related experience, including Title IX.
- A Juris Doctorate is required. Candidate must be licensed to practice law in the State of Maryland.
- Strong problem solving & conflict resolution skills, including the ability to anticipate issues and concerns whenever possible. Current working knowledge of local, state and federal legislation governing compliance, including Title IX, VAWA, Clery Act. Strong and effective interpersonal skills the ability to listen well and demonstrate sensitivity to and respect for individual needs.
Hours Per Week:
- Credential as a trained mediator.
- Experience reporting to a senior counsel, senior partner, College president, or other high level administrator. Experience in employment law is preferred.
