De Lage Landen, a fully owned subsidiary of the Rabobank Group, is an international provider of high-quality, asset-based products that provide leasing and financial solutions to business partners throughout the Americas and Europe, currently seeks a Workout/Recovery professional, to join our home office staff, located in Wayne, Pennsylvania.
Summary & Purpose:
Responsible for workout and litigation activity with the primary goal of maximizing returns on non-performing commercial accounts.
Responsibilities:
- Partner with borrowers on commercial loan workouts and restructurings, loan amendments, bankruptcy and commercial loan collection, recovery and related litigation.
- Collect, prepare and analyze business and financial statements to administer the turnaround or exit of complex credit relationships which includes the decision to provide additional financing or liquidate collateral to offset losses.
- Aggressively and independently negotiates on behalf of De Lage Landen, which involves evaluating the cost/benefit of specific actions including litigation, replevin and abandonment, and following through on final course of binding action.
- Utilizes early warning and problem identification techniques to minimize loss given default.
- Interacts frequently with individuals throughout the organization including senior management, business unit leaders and credit managers.
- Prepares documents to be distributed concerning the disposition of cases in litigation/bankruptcy. These write-ups are technical and highly detailed and the writer must be able to convey important information to a wide variety of audiences.
- Initiates all legal action for assigned accounts and acts as a contact with internal and external attorneys on all litigation and bankruptcy matters.
- Maintains appropriate documentation on actions and decisions.
- Participates in strategy meetings on pending/high potential litigation/bankruptcy matters and identifies and implements solutions.
- Arranges for repossession of equipment in accordance with external laws and codes and internal policy and procedures
Requirements
- Workout experience of 8+ years is required.
- Experience in commercial banking loan/lease restructuring is required.
- Knowledge of various resolution strategies for complex and routine workout situations.
- Technical knowledge in: loan restructures litigation and bankruptcy initiatives, deal documentation and financial analysis.
- Proficiency in loan documentation and knowledge of state and federal law.
- Ability to negotiate in the best interest of DLL and under difficult circumstances.
- Strong organizational, negotiating and analytical skills, with focus on problem resolution.
- Proficient in Microsoft Office products.
Education & Additional Credentials:
- Bachelor’s degree or equivalent work experience.
